These Terms of Service ("Terms") govern your use of Kitae ("the app", "we", "our"). By using Kitae, you agree to these Terms.
1. The Service
Kitae is a fitness tracking application for iOS that lets you log strength workouts, track cardio sessions, create templates, review training history, view analytics, and optionally integrate with Apple Health. Core app data sync uses Apple iCloud and CloudKit.
2. iCloud and Device Requirements
- Some features require a compatible iPhone, iOS permissions, an internet connection, and a signed-in Apple iCloud account.
- You are responsible for maintaining access to your Apple account, device, and iCloud storage. Kitae does not control Apple account availability or iCloud service behavior.
- Optional features such as Apple Health, Location, Motion, Notifications, and widgets require the relevant iOS permissions.
3. Your Content
You retain ownership of the workouts, routes, templates, custom exercises, notes, profile details, feedback, and other content you create in Kitae. You grant us a limited right to store, process, display, and sync that content only as needed to operate and improve the app.
4. Acceptable Use
You agree not to:
- Use the app for unlawful, harmful, abusive, or fraudulent activity.
- Submit feedback or content that is abusive, misleading, spam, or infringes someone else's rights.
- Attempt to access, disrupt, reverse engineer, or interfere with the app or its services.
- Use automated systems to overload, scrape, or abuse app services such as the feedback board.
5. Health and Fitness Disclaimer
Kitae is a tracking tool, not a medical device, healthcare provider, or substitute for professional medical advice. The app is intended for general fitness logging and informational purposes only.
- Workout, calorie, heart rate, pace, distance, elevation, and recovery data may be incomplete or inaccurate.
- GPS and sensor measurements depend on device hardware, permissions, signal quality, and environment.
- Consult a qualified healthcare professional before starting or changing an exercise program.
- You are responsible for exercising safely and stopping if an activity feels unsafe.
6. Availability, Sync, and Data
- Kitae supports local/offline use, but syncing depends on Apple CloudKit, network availability, permissions, and device state.
- We aim to preserve your data, but no software or sync service can be guaranteed to be uninterrupted or error-free.
- We may add, modify, or remove features over time.
7. Feedback
If you submit feedback, bug reports, ideas, or comments, you allow us to read, store, display, moderate, and use that feedback to operate and improve Kitae. We may remove feedback that violates these Terms or is no longer relevant.
8. Intellectual Property
Kitae, including its design, code, brand, and exercise catalog, is owned by us or our licensors and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from the app except as permitted by law.
9. Termination
- You may stop using Kitae at any time.
- We may suspend or restrict access to app-operated services if you violate these Terms.
- Data deletion and retention are described in the Privacy Policy.
10. Limitation of Liability
To the maximum extent permitted by law, Kitae is provided "as is" and "as available" without warranties of any kind. We are not liable for indirect, incidental, special, consequential, or punitive damages, including data loss, sync interruptions, inaccurate tracking data, fitness injuries, or reliance on app outputs.
11. Changes to These Terms
We may update these Terms from time to time. We will indicate changes by updating the date at the top of this page. Continued use of Kitae after changes means you accept the updated Terms.
